MAYA Civium™ Information Service

IMPORTANT NOTICE:

YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS OF SERVICE ("TOS") BEFORE USING THE Civium™ Information Commons, a network of digital publishers ("Service") PROVIDED BY MAYA DESIGN, INC. ("MAYA"). YOUR USE OF THE SERVICE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS OF SERVICE. IF YOU DO NOT ACCEPT THESE TERMS OF SERVICE, YOU ARE NOT AUTHORIZED TO USE THE SERVICE AND YOU WILL NOT BE PROVIDED ACCESS TO SERVICE.

IMPORTANT NOTE: THE SERVICE MAY BE USED TO PUBLISH AND REPRODUCE MATERIALS. YOU MAY ONLY USE THE SERVICE TO PUBLISH OR REPRODUCE NON-COPYRIGHTED MATERIALS, MATERIALS IN WHICH YOU OWN THE COPYRIGHT, OR MATERIALS YOU ARE AUTHORIZED OR LEGALLY PERMITTED TO PUBLISH OR REPRODUCE. IF YOU ARE UNCERTAIN ABOUT YOUR RIGHT TO COPY ANY MATERIAL, YOU SHOULD CONTACT YOUR LEGAL ADVISOR.

DESCRIPTION OF SERVICE. MAYA provides users with the ability to browse, search and publish in the Service. The Service may be used with the MAYA Civium™ workbench software and/or through a web browser or other applications. Once registered with MAYA, each user may be provided with the ability to publish content in the MAYA Civium™ Information Commons ("Content"). Copies of this Content may reside on your computer, MAYA's servers and on the computers of third parties.

You understand and agree that the Service, including all new features provided with the Service, is provided "AS-IS" and that MAYA assumes no responsibility for any content, user communications or personalization settings. You are responsible for obtaining access to the Service and that access may involve third party fees (such as ISP charges). In addition, you must provide and are responsible for all equipment necessary to access the Service.

You understand and agree that the Service is designed to enable "peer-to-peer" connections among computers for purposes of direct communication, data exchange and interaction with minimum involvement of central computer servers. The Service makes certain information about your computer available to other users and computers as part of the peer-to-peer exchange. You acknowledge and consent to the fact that the Service creates such peer-to-peer connections, and you agree that MAYA is not responsible for the conduct of any party (or their computers) who interacts with you or your computer as a result of your installation or use of the Service.
MODIFICATIONS. MAYA may modify and update the TOS without notice at any time. You can review the current version of the terms of service at www.civium.maya.com/legal Failure to comply with the current version of the TOS may result in account revocation.

MAYA reserves the right, without notice at any time, to modify or discontinue, temporarily or permanently, the Service (or any part thereof), or to assign MAYA's rights hereunder to any third party. You agree that neither MAYA, nor its successors or assigns, shall be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
YOUR REGISTRATION OBLIGATIONS. Account registration and verification is required in order to use the Service. During registration, all users are required to provide accurate, complete and current information about themselves in all required fields. Users under 18 years of age are required to have a parent or guardian review and complete the registration process. Should any of your own information change after submitting it to MAYA, you are required to update that information as soon as possible. Should MAYA suspect that your personal information is not complete, current or accurate, your account may be subject to suspension or termination.

You are responsible for maintaining the confidentiality of your password and are fully responsible for all activities that occur under your MAYA account. You agree: (a) neither to provide your MAYA password to any third party, nor to allow any third party to access your MAYA account; (b) to immediately notify us of any unauthorized use of your MAYA account or any other breach of security; and (c) that you will establish and maintain only one MAYA registration at a time.
PRIVACY. You acknowledge, consent and agree that MAYA may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third-parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of MAYA, its users and the public.

MAYA respects the privacy of all personal information you provide to the Service and shall use such information solely for the operations of the Service. Your use of the Service is subject to MAYA's privacy policy. For information on MAYA's privacy practices, please see the entire privacy policy at www.civium.maya.com/privacy
MEMBER CONDUCT. You understand that all Content on the Service is the sole responsibility of the Service member who published it. You agree to not use the Service to:

Publish any Content that is unlawful, abusive, harassing, tortuous, defamatory, obscene, libelous, invasive of another's privacy, or racially, ethnically or otherwise objectionable;

harm minors in any way;

impersonate any person or entity, including without limitation, any MAYA official, content editor, guide or host, forge or otherwise manipulate identifiers in order to disguise the origin of any Content published via the Service, or falsely state or otherwise misrepresent your affiliation with a person or entity;

publish any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (inside information, proprietary and confidential information disclosed as part of employment relationships or under nondisclosure agreements, etc.);

publish any Content that infringes any patent, trademark, trade secret, copyright or other intellectual property or other proprietary rights of any party;

publish any material that contains software viruses or any other computer code that interrupts, destroys or limits the functionality of any computer software or hardware or telecommunications equipment; or

intentionally or unintentionally violate any applicable local, state, national or international law, regulation or order, including without limitation, any laws regarding privacy or any regulations promulgated by the SEC or any rules of any national or other securities exchange.

You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. You acknowledge that MAYA may or may not pre-screen Content, but that MAYA and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. You agree to evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.
INDEMNITY. You agree to indemnify and hold MAYA, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any alleged claim or demand, including reasonable attorney fees, made by any third party due to or arising out of your Content, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another, whether you are a registered user or not.
SPECIAL ADMONITIONS FOR INTERNATIONAL USE. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.
TERMINATION. You agree that MAYA, in its sole discretion, may terminate your account for any reason, including and without limitation, lack of use or if MAYA believes that you have violated the TOS. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that MAYA may immediately deactivate or delete your MAYA content and all related information. You agree that MAYA shall not be liable to you or any third-party for any termination of your access to the Service.
LINKS. The Service may provide links to other web sites or resources. You acknowledge and agree that MAYA shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of, or reliance on, such links.
CONTENT. Guidelines for posting content shall be as follows:

Should any Content be reported to MAYA as being offensive or inappropriate, MAYA may call upon the poster to retract, or modify the Content in question. MAYA has the full authority to terminate any such reported and verified account holding such inappropriate Content but is under no obligation to restrict or monitor Content in any way;

MAYA claims no ownership or control over any Content contributed by its users. The user posting any Content represents that the contributor has all rights necessary to contribute such Content (and for MAYA to serve such Content) without violation of any intellectual property or other rights or any laws or regulations;

MAYA encourages users to contribute their creations to the public domain and our default rights setting for all content is public domain. However, we support a wide range of rights possibilities and offer the ability to mark your content as licensed under a Creative Commons or other limited basis. http://creativecommons.org.
DISCLAIMER OF WARRANTIES. YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
1. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MAYA MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. MAYA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
2. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. NO CONTENT OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MAYA OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY.
LIMITATION OF LIABILITY. YOU EXPRESSLY UNDERSTAND AND AGREE THAT MAYA SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER LOSSES (EVEN IF MAYA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR COMPUTER, TRANSMISSIONS OR DATA; (iii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (iv) ANY OTHER MATTER RELATING TO THE SERVICE.
EXCLUSIONS AND LIMITATIONS. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.
SPECIAL ADMONITION FOR SERVICES RELATING TO FINANCIAL MATTERS. The Service is provided for informational purposes only, and no Content included in the Service is intended for trading or investing purposes. MAYA and its licensors shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the Service, and shall not be responsible or liable for any trading or investment decisions made based on such information.
NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT. MAYA respects the intellectual property of others, and we ask our users to do the same. MAYA may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be infringers. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide MAYA's Copyright Agent the following information:
1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
2. a description of the copyrighted work or other intellectual property that you claim has been infringed;
3. a description of where the material that you claim is infringing is located.
4. your address, telephone number, and email address;
5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
6. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

NO RESALE OR OTHER TRANSFER. Your MAYA account is personal to You. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service. You may not assign or otherwise transfer your MAYA account without the prior written consent of MAYA.

GENERAL INFORMATION.

Entire Agreement. The TOS constitutes the entire agreement between you and MAYA and governs your use of the Service, superseding any prior agreements between you and MAYA with respect to the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other MAYA services, affiliate services, third-party content, or third-party software.

Choice of Law and Forum. The TOS and the relationship between you and MAYA shall be governed by the laws of the State of Pennsylvania without regard to its conflict of law provisions. You and MAYA agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Allegheny County, PA.

Waiver and Severability of Terms. The failure of MAYA to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.

SOFTWARE LICENSE AGREEMENT

YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND RESTRICTIONS BEFORE INSTALLATION OR USE OF ANY SOFTWARE PROGRAM FROM MAYA DESIGN, INC. YOUR CLICKING THE "ACCEPT" ICON OR USE OF THE MAYA SOFTWARE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS AND RESTRICTIONS. IF YOU DO NOT ACCEPT THESE TERMS AND RESTRICTIONS YOU ARE NOT AUTHORIZED TO USE THE MAYA SOFTWARE AND YOU WILL NOT BE PROVIDED ACCESS TO THE MAYA SOFTWARE.

IMPORTANT NOTE: THE MAYA SOFTWARE MAY BE USED TO REPRODUCE MATERIALS. IT IS LICENSED TO YOU ONLY FOR REPRODUCTION OF NON-COPYRIGHTED MATERIALS, MATERIALS IN WHICH YOU OWN THE COPYRIGHT, OR MATERIALS YOU ARE AUTHORIZED OR LEGALLY PERMITTED TO REPRODUCE. LICENSE. Subject to the terms and conditions of this Software License Agreement ("Agreement"), MAYA Design. Inc. ("MAYA") hereby grants you a limited, non-exclusive, non-transferable, revocable license to use the Civium™ workbench which includes the Visage Information Architecture ("VIA") Repository, Embeddable Version in object code form and all documentation ("Licensed Software"), solely for the purposes of your internal, personal, non-commercial use. This Agreement must accompany all copies of the Licensed Software, and must be accepted before installing or using the Licensed Software on any computer. The terms of this License will govern any software upgrades or new modules involving additional capabilities provided by MAYA that replace and/or enhance the original Licensed Software, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.
INTELLECTUAL PROPERTY RIGHTS. The Licensed Software is protected by copyright and other intellectual property rights. MAYA retains all intellectual property rights to the Licensed Software and reserves all rights not expressly granted in this Agreement. Portions of the Licensed Software may have been developed by one or more third parties, who shall each have the right and ability to enforce those provisions of this Agreement which relate to intellectual property and confidentiality restrictions and protections.

Certain open source components and third party open source programs provided with the Licensed Software have been or may be made available by MAYA on its Open Source web site (http://www.cicium.com/opensource) (collectively the "Open-Sourced Components"). This Agreement does not apply to these Open-Sourced Components. The license for any Open-Sourced Components provided to you is located in the source code for such software. Nothing in this Agreement shall limit your rights under the terms of any applicable license for Open Sourced Components. You may modify or replace only these Open-Sourced Components; provided that: (i) the resultant software is used, in place of the Licensed Software and the unmodified Open-Sourced Components, for only the purposes permitted in this License; and (ii) you otherwise comply with the terms of this License and any applicable licensing terms governing use of the Open-Sourced Components. MAYA is not obligated to provide any maintenance, technical or other support for the Licensed Software used with such modified Open-Sourced Components.

Title and intellectual property rights in and to any content displayed by or accessed through the Licensed Software belongs to the respective content owner. Such content may be protected by copyright or other intellectual property laws and treaties, and may be subject to the terms of use of the third party providing such content.
CONSENT TO ESTABLISHMENT OF PEER-TO-PEER CONNECTIONS. The Licensed Software is designed to enable "peer-to-peer" connections among computers for purposes of direct communication, data exchange and interaction with minimum involvement of central computer servers. The Licensed Software makes certain information about your computer available to other users and computers as part of the peer-to-peer exchange. You acknowledge and consent to the fact that the Licensed Software creates such peer-to-peer connections, and you agree that MAYA is not responsible for the conduct of any party (or their computers) who interacts with you or your Computer as a result of your installation or use of Software or Services.
RESTRICTIONS ON USE AND TRANSFER. You may use the Licensed Software only for your own internal non-commercial purposes and shall not use it for any commercial or operational purposes. With the exception off the Open-Sourced Components, noted above, you may not modify the Licensed Software in any manner and shall not sublicense, assign or transfer the Licensed Software or any rights to use it, either in whole or part, to any third party. You shall not copy the Licensed Software except as reasonably necessary for your internal use of the Licensed Software in accordance with this Agreement. All copies of the Licensed Software must contain all proprietary marks, legends and copyright notices that appear on the original copies of the Licensed Software delivered to you by MAYA. You agree that the Licensed Software, including without limitation its source code, is confidential and proprietary to MAYA and/or its licensors. Accordingly, you shall not (i) decompile, disassemble, reverse engineer or otherwise manipulate the Licensed Software so as to derive such source code, or (ii) disclose the Licensed Software, or any portion thereof, to any third party.
PAYMENT AND TERM. There is no license fee for Licensed Software. The term of this Agreement becomes effective as of the date you receive the Licensed Software and shall remain in effect until terminated herein. This Agreement will terminate automatically if you fail to comply with any of its terms or conditions, including, without limitation, if you make any attempt to make an unauthorized copy of the Licensed Software. This Agreement will also terminate, at MAYA's sole discretion, if you are found to have violated the MAYA Civium™ Information Commons Terms of Service. The Terms of Service can be found at civium.maya.com/legal. Sections 2, 4, 5, 6, 7, 8, 9 and 10 shall survive the expiration or termination of this Agreement for whatever reason. Immediately upon termination or expiration of this Agreement, you shall destroy all copies of the Licensed Software.
INDEMNIFICATION. You agree to defend and indemnify MAYA and its affiliates, and all of their officers, directors, shareholders, legal representatives, employees, successors, assigns, and agents and hold them harmless from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and litigation expenses), relating to or arising from your use of the Licensed Software, the acts or omissions of your employees and agents, or your breach of this Agreement.
NO WARRANTY. The Licensed Software is provided "AS IS" without warranty of any kind. MAYA does not warrant that the functions contained in the Licensed Software will meet your requirements or that the operation of the Licensed Software will be uninterrupted or error-free. MAYA HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE LICENSED SOFTWARE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights that vary from one jurisdiction to another.
NO LIABILITY. IN NO EVENT SHALL MAYA OR ANY OTHER PARTY WHICH HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THE LICENSED SOFTWARE BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING FROM OR RELATED TO THIS AGREEMENT OR THE LICENSED SOFTWARE, INCLUDING, WITHOUT LIMITATION, DIRECT, CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES OR DAMAGES FOR LOST PROFITS OR LOSSES RESULTING FROM BUSINESS INTERRUPTION OR LOSS OF DATA, REGARDLESS OF THE FORM OF ACTION OR LEGAL THEORY UNDER WHICH THE LIABILITY MAY BE ASSERTED, EVEN IF ADVISED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH DAMAGES. THE FOREGOING LIMITATIONS SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
EXPORT. You may not, directly or indirectly, use or otherwise export or re-export the Licensed Software except as authorized by United States law and the laws of the jurisdiction in which the Licensed Software was obtained. By using the Licensed Software, you represent and warrant that you are not located in, under control of, or a national or resident of any embargoed country or on any prohibited lists, including, without limitation, the Specially Designated National, Denied Person or Denied Entry Lists.
U.S. GOVERNMENT RESTRICTED RIGHTS. If you are using the Licensed Software on behalf of the U.S. Government, the following provisions apply: (i) if the Licensed Software is supplied to the Department of Defense or any related agency or service, the Licensed Software is classified as "Commercial Computer Software" and the Government is acquiring only rights as set forth in this Agreement; and (ii) if the Programs are supplied to any other unit or agency of the United States Government, the Licensed Software is considered "restricted computer software" and the Government's rights in the Licensed Software are set forth in the Federal Acquisition Regulations. The Contractor for the Programs is Maya Design, Inc., Building 2, Suite 300, 2730 Sidney Street, Pittsburgh, Pennsylvania 15203.
MISCELLANEOUS. If any provision of this Agreement is held to be invalid or unenforceable under any circumstances, its application in any other circumstances and the remaining provisions of this Agreement shall not be affected. This Agreement may not be assigned without the prior written consent of MAYA. No waiver of any right under this Agreement shall be effective unless given in writing by an authorized representative of MAYA. This Agreement shall be governed and construed in all respects by the laws of the Commonwealth of Pennsylvania, U.S.A. without giving effect to principles of conflict of laws. Any notice required or permitted to be given under this Agreement shall be given in writing and shall be effective from the date delivered by hand or sent by registered mail, certified mail or overnight courier. This Agreement is the complete and exclusive statement of the agreement between parties regarding the subject matter hereof, and that it supersedes any proposal or prior agreement, oral or written, and any other communication relating to the subject matter hereof.

YOUR USE OF THE PROGRAMS AND SERVICES ACKNOWLEDGES THAT YOU HAVE READ THIS SOFTWARE LICENSE, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AND RESTRICTIONS. YOU FURTHER AGREE THAT THIS LICENSE IS THE COMPLETE AND EXCLUSIVE STATEMENT OF YOUR AGREEMENT WITH MAYA DESIGN, INC AND SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS RELATING TO THE SUBJECT MATTER OF THIS LICENSE.

PRIVACY POLICY

MAYA DESIGN INC

MAYA Design, Inc. ("MAYA") shares your concerns about maintaining the privacy of personal information collected on the Internet. The following Privacy Policy discloses the information gathering and dissemination practices of MAYA in connection with the MAYA.com website (including all web and internet properties with the "maya.com" domain) ("Site"). Use of the Site constitutes consent to MAYA's collection and use of personal data as outlined herein.

SCOPE. This policy covers how MAYA treats personal information that MAYA collects and receives, including information related to your past use of Site.
COLLECTION OF PERSONAL INFORMATION FROM SITE USERS; COOKIES. MAYA provides services and Content through the Site and, generally, does not use the Site for the sole purpose of collecting personal information from users. However, as part of providing such services and Content, MAYA may collect and/or track (1) the home server domain names, e-mail addresses, type of computer, and type of Web browser of users to the Site, (2) the e-mail addresses of users that communicate with MAYA or the Site via e-mail, (3) information knowingly provided by users in online forms, registration forms, surveys, etc. (including name, address, e-mail and other personal profile data), and (4) aggregate and user-specific information on which pages users access.
MAYA may place Internet "cookies" on users' hard drives. Internet cookies save data about individual users, such as the user's screen preferences, the dates and times of previous visits and the pages viewed by the user. When the user revisits the Site, MAYA may recognize the visitor by the Internet cookie and customize the user's experience accordingly. Users may decline Internet cookies, if any, by using the appropriate feature of their Web browser software, if available. However, declining to use cookies may impede the ability of the Site to function properly.

When a user performs a search within the Site, MAYA may record information identifying the user or linking the user to the search performed. MAYA may also record limited information associated with every search request made by the user and use that information to, among other things, solve technical problems with the service.

In the event of a transfer of ownership of MAYA, such as acquisition by or merger with another company, MAYA will provide notice before any personal information is transferred and becomes subject to a different privacy policy.
USE OF PERSONAL DATA COLLECTED. MAYA may use the data it collects for internal purposes, namely, for solving technical problems, calculating overall usage statistics, for internal marketing and promotional purposes, product development, and content improvement. MAYA will not disclose to third parties any personal information, except to the extent necessary to comply with applicable laws or legal processes (e.g. subpoenas), or to protect the rights or property of MAYA. MAYA will cooperate with law enforcement authorities.
SECURITY MEASURES. MAYA takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. MAYA restricts access to your personal information to employees who need to know that information to operate, develop or improve our services. Please note, however, that MAYA cannot guarantee the confidentiality of any communication or material transmitted to/from MAYA via the Site or e-mail. Accordingly, MAYA is not responsible for the security of information transmitted via the Internet.
OPT-OUT RIGHT. Users may at any time opt out of having their personal information used by MAYA to send promotional correspondence to the user, by contacting MAYA via telephone, e-mail or postal mail at the address(es) below:

ACCESS TO AND ABILITY TO CORRECT PERSONAL DATA. Upon request via postal mail or e-mail, MAYA will provide to users a summary of any personal information retained by MAYA regarding the user. Users may modify, correct, change or update personally identifiable information that MAYA has collected by the Site or may cause their personal record to be removed from MAYA's database by contacting MAYA via postal mail or e-mail to the addresses indicated in paragraph 5 above.
COLLECTION OF PERSONAL DATA FROM CHILDREN. MAYA does not knowingly solicit information from children and we do not knowingly market the Site or its services to children.
MAYA'S RIGHT TO CONTACT USERS. MAYA reserves the right to contact users of the Site who have provided MAYA with contact information, unless they opt-out of such communication as provided in paragraph 5 above.
